The special part of the penal code is just a detailed logic order of the general part that facilitates and establishes the basic principles that all crimes subjugated thereto, even not stops at the limits of application of the general part, since it takes on clarification of the right or interest protected by the law under each conviction clause

The author studies the development of penal thought throughout the ancient and modern times, punishment remarkable features throughout different historical epochs and the role of criminology schools in evolution of punishment philosophy.            

Study of criminology and penology are in close contact with the penal code and criminal procedural law in view of the strong relation among either of them and both are relatively modern sciences.  And the constitution of criminology starts with the hasty progress that human sciences have achieved. By examining evolution movement of criminology it is clear evident that this science has flourished only by virtue of efforts of the Italian physicians and scientists that made late in the 19th  century by using scientific research methodology in studying criminal phenomena.  That was by checking human personality in general whether he is criminal or not, which dose not mean non-existence of any explanation of the criminal behavior but the later lacks the scientific methodology.

One of Al-Fateh Revolution principals is the overruling of the regular army    (the armed forces) and building up the armed people's, on the grounds that defense is the responsibility of each male and female national.  Starting from this point the armed people's institution was built up the fact which necessitates developing of the laws, duly in line with the expected purposes and entrusted function.  Such development includes organization of the general panel of judiciary at the armed people by away that materializes the objective of overall organization.
